We are representing a plaintiff in a putative class action in Trull v. McCreary Modern, Inc., et al. (W.D.N.C. Jan. 17, 2025). Our client is a former participant in the McCreary Modern, Inc. ESOP. We allege that the ESOP’s fiduciaries violated their duties under ERISA by imprudently investing Plan assets in low-yield short term investments for long periods. Had the ESOP been prudently managed, participants would have more in their accounts. We are seeking to recover additional benefits on behalf of ESOP participants.
