Bed Bath & Beyond, Inc. 401(k) Savings Plan
We are representing participants in the Bed Bath & Beyond, Inc. 401(k) Savings Plan, who lost millions of dollars in retirement savings when Bed Bath & Beyond declared bankruptcy, causing the Plan’s capital preservation option to be subjected to a substantial market value adjustment. These losses would not have occurred had the Plan’s fiduciaries prudently monitored the Plan’s investments and replaced investments subject to such an adjustment in light of the well-known risk of bankruptcy the company had faced for several years.
